Lead with refund percentage, total refunds, and experience-factor/premium impact. L&I explains retro as a program where employers may earn a partial refund by reducing workplace injuries and lowering claim losses, and competitor pages are also selling lower premiums, lower EMR, and refunds.

Your scorecard page already says employers should focus on multi-year consistency, not the highest refund in one year.

This matters a lot. Vigilant’s own retro article frames assessments as the nightmare scenario: expected refunds turning into unexpected costs, usually tied to rising claim costs, weak communication, inconsistent safety/RTW, and large claims without a plan. Neither group has ever had a third adjustment assessment.

For both, safety services are included, assistance with attorneys fees, various reimbursements, assistance with Stay at Work at no additional cost (Other groups charge for this), claims management, investigative services.

Refunds in Washington’s Retrospective Rating Program vary by employer and by year, but for well-managed programs they can be significant. For example, Redpoint’s manufacturing group (Washington Manufacturers Counsel) has refunded 40% of member’s premium each year on average over the last eight years.

Refunds are based on how your actual claims costs compare to what you paid in standard L&I premiums. Employers with strong claims advocacy, early return to work strategies, and active safety programs often see meaningful refunds over time. While no refund can ever be guaranteed, our role is to manage claims aggressively and strategically to maximize your opportunity for a favorable Retro outcome.

In the event claim costs exceed a certain pre-determined threshold, an assessment may occur. An assessment means additional premium must be paid to Labor and Industries. This risk is either minimized or eliminated completely through participation in a group.

Retro is a long-term strategy, not a quick rebate. Refunds are typically issued after the close of the coverage year, once L&I has sufficient claims development to calculate final results. In most cases, employers see their first potential refund one to two years after joining, with additional adjustments possible in later years as claims develop. This structure rewards consistent claims management and long-term loss control.

In addition to L&I’s adjustment schedule, your Retro group will most likely hold an amount of the refund for distribution in later adjustments to avoid over-distributing funds.

Yes. Participation in Retro requires meeting basic eligibility standards set by Labor and Industries, including being in good standing with L&I. In addition, each Retro group may have its own underwriting guidelines based on industry, loss history, and program capacity. We review eligibility carefully upfront so employers have a clear understanding of it before joining.

Employers that do not receive underwriting approval are offered the chance to work with us on managing claims for a period of time to get into “Retro shape.” This gives us time to establish a working relationship, build processes to decrease frequency and severity of claims, and implement early return to work systems.

Not all companies qualify, and not all companies are a good fit. Retro works best for employers who are committed to proactive claims management, return to work, and improving workplace safety over time. Some industries, claim histories, or employer sizes may limit eligibility in certain groups. Our job is to evaluate whether Retro makes sense for your business and be honest if another strategy would be more appropriate.

Retro members receive hands-on claims management from experienced claims professionals with deep L&I backgrounds. This includes ongoing claim oversight, employer advocacy, and coordination with return to work efforts. Members also have access to workplace safety support designed to reduce future claims and improve overall performance. Retro is most effective when claims management and safety are addressed together.

Some Retro groups may offer discounts or even cover the cost of legal or investigative services on applicable claims, which can be significant.
